Please read these Terms of Service carefully before using the Nestspot platform. These Terms explain your rights and obligations as a user, as well as ours.
1. Acceptance of Terms
By downloading, installing, or using the Nestspot mobile application or website (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, you must not use the Platform.
These Terms constitute a legally binding agreement between you and Nestspot. We may update these Terms from time to time; continued use after the effective date of any update constitutes acceptance.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract under Nigerian law to use the Platform.
By registering, you represent that all information you provide is accurate, current, and complete. You are responsible for maintaining the accuracy of your account information.
3. The Nestspot Platform
Nestspot is a property search and transaction platform that:
— Lists residential properties that have been GPS-verified by our team or authorised field representatives.
— Facilitates direct communication between tenants and landlords via in-app messaging.
— Offers an escrow payment service so that rent funds are held securely and released only upon confirmed key handover.
— Provides digital lease signing functionality.
Nestspot is a technology platform, not an estate agent, property manager, or party to any lease agreement between landlords and tenants.
4. Landlord Responsibilities
If you list a property on Nestspot, you represent and warrant that:
— You are the legal owner or an authorised representative of the property.
— The property exists at the GPS coordinates you have provided and all listing details are accurate.
— You hold all required permits or approvals to legally let the property.
— You will not demand additional or undisclosed fees outside the platform.
Nestspot reserves the right to remove any listing that does not meet verification standards without notice.
5. Tenant Responsibilities
If you use Nestspot to search for or rent a property, you agree to:
— Conduct viewings in good faith and only arrange visits through the platform's messaging system.
— Use the escrow payment system for all rent transactions initiated on the platform.
— Not circumvent the platform by making off-platform payments to avoid fees, which voids Nestspot's protections.
— Report any suspected fraudulent listings to support@nest-spot.com immediately.
6. Escrow Payments
Payments processed through the Nestspot escrow service are governed by the terms of our regulated payment partner. Key points:
— Funds are held in a designated escrow account and are not accessible to the landlord until the tenant confirms key handover.
— If the property does not match the listing after viewing, the tenant may raise a dispute within 48 hours of the agreed move-in date.
— Nestspot will adjudicate disputes in good faith. Decisions are final for amounts under ₦500,000; larger amounts may be escalated to binding arbitration.
— Nestspot charges a service fee on each successfully completed transaction, displayed clearly at checkout.
7. Prohibited Conduct
You must not:
— Post false, misleading, or fraudulent listings.
— Impersonate another person or entity.
— Scrape, harvest, or copy platform data without written permission.
— Use the Platform for any purpose prohibited by Nigerian law, including money laundering or fraud.
— Attempt to reverse-engineer, disable, or tamper with platform security measures.
— Harass, threaten, or discriminate against other users.
Violation of any prohibition may result in immediate account suspension and/or legal action.
8. Intellectual Property
All content on the Platform — including the Nestspot name, logo, software, design, text, and data — is owned by or licensed to Nestspot and protected under Nigerian and international intellectual property law.
You are granted a limited, non-exclusive, revocable licence to use the Platform for its intended purpose. You must not reproduce, modify, distribute, or create derivative works without our written consent.
9. Disclaimer of Warranties
The Platform is provided "as is" and "as available". To the maximum extent permitted by Nigerian law, Nestspot disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
While we verify GPS coordinates, we cannot guarantee that every property matches all aspects of its listing at the time of viewing. Tenants should conduct their own due diligence.
10. Limitation of Liability
To the fullest extent permitted by law, Nestspot's total liability arising out of or in connection with your use of the Platform shall not exceed the total fees paid by you to Nestspot in the 12 months preceding the claim.
Nestspot is not liable for indirect, consequential, punitive, or special damages, including loss of profit or business opportunities.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Federal Republic of Nigeria.
Any dispute arising from or related to these Terms shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be referred to arbitration under the Arbitration and Conciliation Act (Cap A18, LFN 2004), with the seat of arbitration in Lagos, Nigeria.
12. Termination
We may suspend or terminate your account at any time for breach of these Terms, suspected fraud, or any reason we deem necessary to protect the Platform or its users.
You may delete your account at any time via app settings. Termination does not release you from obligations arising before the termination date, including outstanding escrow transactions.
